    My husband has a debt that was sent to a collection agency. We have made every payment but 2 and I have called to arrange those missed payments. A few days ago, I got a call from a private number and it was their “lawyer”. He said we had a court date set for the 13th of February. But I haven’t recieved a summons. The out of court payment is 1671. Could this be their way of trying to scare me?

    This legal threat sounds bogus to me. You must be properly served a summons for any real, pending court date. There’s a quick way to find out if this is a “real” legal threat or a debt collector bluffing. Next time they call and make a legal threat, state the following:
    May I have the full name of the attorney who will be taking action against me and his/her license # in the state bar association?

    If this is a real legal threat, they are obligated to provide this info. If they refuse to give this info to you, then the legal threat is bogus
    – Payment plans with debt collectors should always be avoided, as debt collectors are notorious for playing dirty….You are much better off saving your money and settling the debt all at once for less, with all terms in writing before you pay.
    – All you can do now is try to settle the remaining balance. Get all terms in writing first. Don’t be surprised if they try to get much more than the remaining balance.
