    Custody case was established I’m the plaintiff, defendant served with court papers, court date was established, lawyer never informed me of court date and I missed it so court ruled in favor of defendant. Lawyer had all my contact info and never received letter, email, phone call of court date. As a result of me not showing up to this court hearing, because of this incompetent “lawyer” he decides to withdraw from my case and takes my money. Is this legal? Serious educated answers please, thank you!

    He can only use your retainer for services actually performed. If the facts you present are true, then you should file a complaint with your state bar association. Also request a copy of all services performed from your “attorney”. Be aware though that most attorneys will manipulate the billing and claim sufficient services to justify keeping the entire retainer.
